Frida von Fuchs is a print and digital design agency specializing in Logo and Squarespace website design. We help clients around the world to communicate visually and strategically with their customers.

The cookies we use

We use very few cookies; the only information we collect about users are through Squarespace and Squarespace Metrics

Our website uses Squarespace Metrics, a web analytics service provided by Squarespace, Inc, 225 Varick Street, New York, NY 10014, USA ('Squarespace').

The data generated by cookies is transmitted to a Squarespace server in the USA and stored there.

Anonymous access data is stored each time a file is requested from this website. Each data record consists of:

- the page from which the file was requested
- the name of the file
- the date and time of the request
- the amount of data transferred
- the access status (file transferred, file not found, etc.)

- a description of the type of web browser used

This information is used for statistical purposes and serves to improve our offer. Again, you remain anonymous as an individual user.

If Squarespace is required to do so by law, or if third parties process the data on its behalf, the data will be transferred to third parties. Squarespace will never associate your IP address with any other data held by Squarespace. Anonymized personal user data such as your IP address will be retained for a period of 7 days.

Data collected via this website:

1.Collecting information

We collect personal data from visitors to this website only through the use of online forms and email hyperlinks. Additionally, we collect your details when you email us with an inquiry after visiting our website.

2.Secure connection

We use SSL encryption for security reasons and to protect the transmission of confidential content, such as requests that you send us via forms or email. You can recognize an encrypted connection by the fact that the address line of the browser begins with a "https://" and by the lock symbol in your browser line. If SSL encryption is activated, the data you transmit to us cannot be read by third parties.

3.Collecting your data via our contact forms

If you send us an inquiry via contact form, your data will be sent directly to us via e-mail. They will not be stored on external servers.

We store your information for the duration of your request or your order (for the proposal, billing and mandatory work processes such as coordination and consultation by e-mail or telephone). Mandatory legal provisions - in particular retention periods - remain unaffected. All data is processed only by us and stored on our own server. We also never pass on this data to third parties.

4.Inquiries by e-mail and telephone

If you contact us by e-mail or phone, your request including all resulting personal data (name, e-mail address, etc.) will be stored and processed for the purpose of processing your request.

The data you send us will remain with us until you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies (e.g. after your request has been processed). Mandatory legal provisions - in particular legal retention periods - remain unaffected. We also never pass on this data to third parties.

5.Where your personal data is stored

When you submit your data to us through the website or by email, it is stored solely on our own server and only used for the purpose of fulfilling your inquiry.

We will not share your data with third parties unless we are obliged to disclose personal data by law or the disclosure is necessary for purposes of national security, taxation and criminal investigation.

7.Change your preferences

If you’d like to see or remove your personal data from our database, please tell us by email via team@fridavonfuchs.de. We will then delete all your personal data on our server.

 

Terms &
Conditions

Here, we set out our Terms and Conditions, which will apply to the work we do for you. These Terms and Conditions and the proposal supplied to you form the contract between us for the provision of Frida von Fuchs's services.

1.Working with us:

1.1. Services

Frida von Fuchs will provide the services described in the proposal as presented. As an assignment develops, it may be that the scope of the required work changes. Where this is the case, Frida von Fuchs will discuss it with you at the earliest opportunity in order to agree upon any necessary variations to the scope of our services.

1.2. Revisions

Unless stated otherwise, we include 2 rounds of changes on all concepts following the presentation of an initial idea. Revisions briefed thereafter will be charged according to Frida von Fuchs's standard hourly rates. Those rates are 95,00€/hour for graphic and user experience design tasks and 85,00€/hour for website programming and copywriting.

1.3. Communication

To maximise our effectiveness we must work with you as a team. Frequently, our work will be dependent on you providing information and data e.g. copy texts, images or videos promptly. To avoid unnecessary verification, we will assume all information you provide is complete and accurate unless you tell us otherwise.

1.4. Additional Charges

We do our best to avoid any incidentals throughout our joint project. However, rarely, there will be additional costs in the form of font or image licencing, couriers, pre-delivery of printed proofs etc. that will be announced beforehand and charged to your account.

1.5. Termination

We hope that this will never be the case. However, should you wish to terminate the contract after the commencement of work, you will be invoiced for work already completed according to our standard hourly rates (see 1.2.).

2.Payment Terms:

2.1. Payment

Invoices shall be settled by bank transfer into Frida von Fuchs's nominated bank account within 14 days of the date on the invoice unless agreed otherwise. Upon request, we can provide you with a PayPal link to settle your payment. We retain ownership of all work until full payment has been made.

2.2. Payment Plans

For our Design Packages, we have payment plans in place that seek a payment divided into 4 (for the Logo Package) or 6 (for the website package) monthly rates. The first rate will be invoiced prior to the commencement of the project. The following rates will be invoiced in monthly intervals.

3.Scoping:

3.1. Feedback

In most cases, we will present our design concepts and work-in-progress online in a password-protected private client area on our server. We will ask you to give us feedback and refine our work accordingly. Two rounds of these revisions are included in our proposal unless stated otherwise.

3.2. Approval

Once accepted, we will ask you to specifically approve the work that we do for you in writing by email. Any changes made after this approval will be handled as a new update and priced accordingly.

4.Content:

4.1. Content and Images

It is your responsibility to provide us with the required information about your business and marketing objectives. We do not take responsibility for errors in content supplied by you. Any changes thus incurred may be chargeable at standard rates. Unless specified otherwise, it is your responsibility to provide all necessary text and graphic materials that make up the content of the joint project.

4.2. Delivery

All content must be supplied in a suitable digital format unless agreed otherwise beforehand. Images should be supplied as jpeg, gif, tif, png or psd format. Supplied images should always be high-res images at 300DPI for print purposes. If they are solely for use on the web, then lower resolution images are acceptable. We will assume that all images supplied to us are owned by you or have been purchased from stock libraries and are properly licensed. Text should be supplied as a PDF document. Failure to supply material may halt the progress of the project. If the content provided is in a form where a significant amount of copy writing is required, we will charge the additional work at our standard hourly rates.

4.3. Image Rights

If you are using photos of people that you have taken yourself, then we will assume that you have been given the permission to use these images.

4.4. Liability

You agree to indemnify Frida von Fuchs from any and all claims arising from your negligence or inability to obtain proper copyright permissions for all content supplied.

5.Confidentiality:

Frida von Fuchs will keep your documents and affairs confidential at all times, unless you permit disclosure or the relevant circumstances are already in the public domain. We may, however, disclose your documents and affairs to:

(i) our freelancers in order to properly carry out the required task.

(ii) any other service provider to whom we may properly delegate aspects of any assignment in order to provide a full range of services to you.

6.Ownership of Materials:

6.1. Intellectual Property

Frida von Fuchs may develop or use for other clients any ideas, concepts, source code, information or know-how reflected in any of the materials provided to you (in whatever form) or otherwise developed during the course of providing services to you.

6.2. Rights of Usage

Upon full payment, exclusive and unlimited rights of usage of the items provided by us, will be transferred to you. These items do not include concept presentations, rejected concepts, demo images and texts or other work in progress.

6.3. Showcasing

We may retain the right to showcase your project on our website, social media and design portfolio for the sole purpose of promoting our work.

7. Indemnity:

All services may be used for lawful purposes only. You agree to indemnify and hold Frida von Fuchs harmless from any claims resulting from your use of our service that damages you or any other party.

8.Liability:

Our total liability to you in contract or in tort arising in connection with this contract shall not exceed the total price paid by you. We shall have no liability for loss of profits, business, revenue, goodwill or anticipated savings or for any other indirect or consequential loss.

9. Modification:

These Terms and Conditions (and/or the contents of any agreement to which they relate) may be varied or superseded at any time by agreement in writing between us. Any such variation shall not affect any rights or obligations of either of us that may already have accrued, unless otherwise specifically agreed.

1.Design Process

1.1. Digital Proofs

Digital proofs are provided before printing your stationery or merchandises. They will give a preview of what your order will look like upon completion. In addition, the proof reflects the exact written content you have submitted, paper color choices and any other applicable visual elements you have selected.

1.2. Revisions

All revisions should be made based on what you see in your digital proof. Because computer screens vary, and digital screen mock-ups will always slightly differ from physical printing methods, we point out that digital proofs may not be a 100% exact representations of printed stationery and apparel, but still the best way to see a preview of what to expect.

1.3. Approval

Please provide your approval of the digital proof in an email.

Although we try our best to catch all typos, grammatical errors, and other mistakes, your sign off acts as final approval of all content as it appears in the digital proofs. Please double check your final digital proof. We will not be held responsible for any errors that you approve.

1.4. Deadlines

We try our best to complete your projects as soon as possible. However, in order to finalize our design work, you are responsible for submitting forms and approvals of proofs in due time. We will communicate deadlines in order to ensure that we can deliver your stationery or merchandise in time. Should you miss a deadline, we can no longer guarantee to deliver your order as planned.

2.Payment, Taxes and Returns

2.1. Payment

Payment is made in full before the start of the production (design or customization and printing) of your printed goods. By settling your payment, you agree to all terms and policies communicated over email, phone conversations, content forms, and language written on our website.

2.2. Taxes and Tariffs

All prices listed on our website do not include taxes. We will apply taxes to printed goods ordered within Germany.International orders are not taxed by Frida von Fuchs, but customs tariffs may be imposed and applied once your order arrives to your country. You are fully responsible for paying these fees and we are not able to estimate this amount prior to placing an order.

2.3. Returns

Our printed products are customizable and prepared for each individual customer. Because of this, we cannot offer any returns, exchanges, or credits in the event of customer dissatisfaction or order cancellation. However, should you be dissatisfied with your product, please let us know as soon as possible and we will try our best to help you make things right.

2.4. Pricing

Prices listed within our website and shop are subject to change without notice. Invoices will always reflect accurate pricing.

3.Shipping

3.1. Shipping Costs

All prices listed on our website or quoted in your proposal do include shipping fees. We ship both domestically and internationally. International orders may be subject to delays due to customs inspections. These are at the discretion of each country and we are not able to estimate the length of these delays prior to placing an order.

3.2. Liability

Frida von Fuchs will not be held liable for any errors, delays, damaged products, or lost packages due to theft or negligence of the shipping services. Security preferences (signature confirmation, additional insurance, etc.) can be added for additional fees that are calculated prior to shipping.

4.Ownership of Materials

All designs, artwork and layouts used for the Branding Kits and other printed materials are owned by Frida von Fuchs. We maintain full legal ownership of the artwork included on our website, social media, our printed stationery, and other paper or merchandise products. Under no circumstances may any Frida von Fuchs designs or artwork be reproduced, altered, or repurposed in any way, within any print or digital media.

5.Showcasing

Frida von Fuchs retains the right to post images of your product purchases online and on social media for marketing purposes. Doing so, we will never share sensitive personal information, and will ensure those elements are illegible via cropping, covering, or blurring. We are also happy to refrain from posting any images related to your purchases. Just let us know and we’ll gladly take down any photos we may have already posted. Sharing our products via social media is highly encouraged. Please do so with an appropriate line of credit (i.e. tag us on Instagram, hashtag our products, post links to our website, etc.).
